These Terms of Service (“Terms”) govern your use of Mizanvest. By creating an account or using the service, you agree to these Terms. If you are using Mizanvest on behalf of an organization, you represent that you are authorized to bind that organization.
What Mizanvest is
Mizanvest is a software platform for documenting, e-signing, and administering Shariah-compliant Mudarabah (profit-sharing) business agreements between a capital provider and a business operator. Mizanvest is a software provider only. It is not an investment adviser, broker-dealer, fund, custodian, escrow agent, or money transmitter, and it does not offer securities, solicit investments, or provide financial, legal, tax, accounting, or Shariah advice. You are responsible for the lawfulness and Shariah-compliance of your own agreements and for obtaining your own professional advice.
Accounts
You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be of legal age and able to form a binding contract.
Agreements between parties
Agreements created on Mizanvest are between the participating parties — not with Mizanvest. Capital in a Mudarabah is at risk, and profit is shared by an agreed ratio with no guaranteed return of principal or profit. Mizanvest is not a party to your agreements and is not responsible for the conduct of any party, the performance of any venture, or the outcome of any deal.
Payments
Where payments are enabled, money moves directly between the parties through our payment processor (Stripe); Mizanvest does not hold, pool, or take custody of funds. You authorize the relevant transfers when you initiate them and agree to the processor’s terms. Mizanvest may charge a software/platform fee, disclosed before you incur it.
Acceptable use
You agree not to misuse the service: no unlawful, fraudulent, or infringing activity; no attempts to breach security or access others’ data; and no use that violates applicable securities, banking, sanctions, or anti-money-laundering laws.
Disclaimers
The service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that documents generated will meet your legal or Shariah requirements.
Limitation of liability
To the maximum extent permitted by law, Mizanvest will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of capital, profit, or data arising from your use of the service or from any agreement between parties.
Termination
You may stop using the service at any time. We may suspend or terminate access for violation of these Terms or to comply with law. Executed agreements remain binding records.
Changes
We may update these Terms; material changes are reflected by the “last updated” date above. Continued use after changes constitutes acceptance.
